Outdoor Fires

Contained outdoor burning is defined as outdoor buring for recreational purposes in an enclosed container that includes outdoor fireplaces, chimineas, etc. and must meet the below size requirements [Permit Application]

Regulations:

  • An annual permit must be first obtained pursuant to section 1-16 of the Fire Prevention Code
  • Fire permits are only available in areas zoned as R 1 and R 2. If the property is NOT owner-occupied, you must have permission from the landlord.
  • The fire must be continuously attended.
  • A water source must be readily available at all times.
  • Burning of building materials and non wood items is strictly prohibited.
  • An inspection of the property must be carried out prior to obtaining each annual permit.
  • The fire must be at least 20 feet from any roadway (including driveways), any structure, combustible fence and any property line.
  • The container must be located on a non combustible surface.
  • Fires will not be permitted when wind speed is greater than 15 miles per hour, or during a state ban on fires in the area.
  • Size requirements - maximum container size is 3'x3'x3' (exclusive of chimneys and legs). The container may be built but must be enclosed at all times for recreational purposes but does not have to be enclosed if going to be used for cooking.
  • The container must be free of rust or corrosion which affects the integrity of the container. The owner is responsible for inspecting the container prior to each fire as to its integrity.
  • Any permit issued under this section may be limited by imposition of conditions to limit the creation of smoke and/or protect property and health, safety and comfort of persons from the effects of the burning.
  • Any permit may be revoked or canceled by the Fire prevention bureau pursuant to section 1-16 of the Fire Prevention Code.
